कर्नाटक में सभी मुसलमान ओबीसी लिस्ट में शामिल, पिछड़ा वर्ग आयोग की रिपोर्ट में खुलासा

हाल ही में प्रधानमंत्री नरेंद्र मोदी ने आरोप लगाया कि कांग्रेस पार्टी एससी, एसटी और ओबीसी समाज का आरक्षण छीन कर मुस्लिमों को देना चाहती है। कर्नाटक के आँकड़े पीएम मोदी के इन आरोपों की तस्दीक करते हैं। दरअसल, कर्नाटक सरकार ने आरक्षण का लाभ देने के लिए मुसलमानों को पिछड़ा वर्ग (ओबीसी) में शामिल किया है। कर्नाटक सरकार के इस फैसले की जानकारी राष्ट्रीय पिछड़ा आयोग ने प्रेस रिलीज जारी करके दी।राष्ट्रीय पिछड़ा वर्ग आयोग ने इस पर अपत्ति भी जताई है। 

राष्ट्रीय पिछड़ा वर्ग आयोग ने जानकारी दी कि कर्नाटक में शिक्षण संस्थानों और नौकरियों में मुस्लिम समुदाय को आरक्षण मिल रहा है। आयोग ने ये भी जानकारी दी कि कर्नाटक के मुस्लिमों की सभी जातियों और समुदायों को सरकारी नौकरियों एवं शिक्षण संस्थानों में आरक्षण दिया जा रहा है। इस मामले पर कर्नाटक सरकार द्वारा आयोग को कोई स्पष्टीकरण नहीं दी गई है।

राष्ट्रीय पिछड़ा वर्ग आयोग के अध्यक्ष हंसराज अहीर ने कहा कि हमने इस मामले पर कर्नाटक सरकार से पूछा था कि आखिर किस आधार पर यह कोटा दिया जा रहा है। इस मामले पर हमें कोई स्पष्टीकरण नहीं मिला है। हंसराज गंगाराम अहीर के ओर से जारी बयान में कहा गया, कर्नाटक सरकार के नियंत्रणाधीन नौकरियों और शिक्षण संस्थानों में प्रवेश में आरक्षण हेतु कर्नाटक के सभी मुस्लिम धर्मावलंबियों को ओबीसी की राज्य लिस्ट में शामिल किया गया है। बयान में आगे लिखा है,"कर्नाटक सरकार के पिछड़ा वर्ग विभाग ने राष्ट्रीय पिछड़ा वर्ग को लिखित रूप में बताया है कि मुस्लिम और ईसाई जैसे समुदाय न तो जाति है और न धर्म है। कर्नाटक में मुस्लिम की आबादी 12.92 प्रतिशत है। राज्य में मुस्लिमों को धार्मिक अल्पसंख्यक माना जाता है।"

कर्नाटक सरकार की नीती सामाजिक न्याय के सिद्धांतों के विरुद्ध
राष्ट्रीय पिछड़ा वर्ग आयोग ने कर्नाटक की इस नीति को सामाजिक न्याय के सिद्धांतों के विरुद्ध बताया है। पिछले साल NCBC ने ग्राउंड पर जाकर आरक्षण की स्थति का पता लगाया था। आयोग का कहना है कि ऐसे में मुस्लिमों में जो जातियाँ शिक्षिक-सामाजिक रूप से पिछड़ी हैं उनकी भी हकमारी हो रही है। सभी मुस्लिमों को पिछड़े समाज में डालना इस समाज की विविधता और जटिलता को नज़रअंदाज़ करने के जैसा है। 

कर्नाटक सरकार से स्पष्टीकरण मांगा
हंसराज अहीर ने कहा कर्नाटक में कैटेगरी 1बी और बी2 में कुल 34 मुस्लिम ओबीसी जातियां आती हैं, लेकिन आरक्षण जो दिया है वो समूचे मुस्लिम जातियों को दे दिया गया है। हमने पूछा कि 4 प्रतिशत की जगह 16 प्रतिशत आरक्षण कैसे दिया तो उनका गोलमोल जवाब आया है। हंसराज अहीर ने कहा कि हमने कर्नाटक सरकार से स्पष्टीकरण मांगा है। हम कर्नाटक के चीफ सेक्रेटरी को तलब कर रहे हैं। हम किसी भी तरह मूल ओबीसी के हक को मरने नहीं देंगे। हमारे आयोग का यही काम है। जरूरत पड़ेगी तो हम कर्नाटक में ओबीसी आरक्षण के कोटा से इनको हटाएंगे। हम राष्ट्रपति से भी शिकायत कर सकते हैं। बहुत सारे कानूनी उपाय हैं।

ओबीसी आरक्षण कोटे में अनियमितता की शिकायत के बाद जांच
दरअसल, राष्ट्रीय पिछड़ा आयोग को कर्नाटक में ओबीसी आरक्षण कोटे में अनियमितता की जानकारी मिली थी। उसके बाद आयोग ने पिछले 6 महीने में इसकी जांच शुरू की। आयोग ने अपने जांच के दरमियान सरकारी नौकरी, मेडिकल, इंजीनियरिंग एडमिशन और तमाम सरकारी पदों पर सीमा से अधिक मुस्लिम आरक्षण दिए जाने की बात सामने आई। गत वर्ष राज्य के सरकारी पीजी मेडिकल के 930 सीटों में दिए गए आरक्षण की जब जांच की तो उसमें चौकाने वाले तथ्य सामने आए। आयोग ने पाया कि 930 में से 150 सीट मुस्लिम वर्ग को आरक्षित किया गया है जो करीब कुल सीट का 16 प्रतिशत है। खास बात ये है कि इनमें मुस्लिम वर्ग के उन जातियों को भी लाभ दिया गया है जो आरक्षण के दायरे में नहीं आते।

कर्नाटक में सभी मुसलमान ओबीसी लिस्ट में शामिल, पिछड़ा वर्ग आयोग की रिपोर्ट में खुलासा

हाल ही में प्रधानमंत्री नरेंद्र मोदी ने आरोप लगाया कि कांग्रेस पार्टी एससी, एसटी और ओबीसी समाज का आरक्षण छीन कर मुस्लिमों को देना चाहती है। कर्नाटक के आँकड़े पीएम मोदी के इन आरोपों की तस्दीक करते हैं। दरअसल, कर्नाटक सरकार ने आरक्षण का लाभ देने के लिए मुसलमानों को पिछड़ा वर्ग (ओबीसी) में शामिल किया है। कर्नाटक सरकार के इस फैसले की जानकारी राष्ट्रीय पिछड़ा आयोग ने प्रेस रिलीज जारी करके दी।राष्ट्रीय पिछड़ा वर्ग आयोग ने इस पर अपत्ति भी जताई है। 

राष्ट्रीय पिछड़ा वर्ग आयोग ने जानकारी दी कि कर्नाटक में शिक्षण संस्थानों और नौकरियों में मुस्लिम समुदाय को आरक्षण मिल रहा है। आयोग ने ये भी जानकारी दी कि कर्नाटक के मुस्लिमों की सभी जातियों और समुदायों को सरकारी नौकरियों एवं शिक्षण संस्थानों में आरक्षण दिया जा रहा है। इस मामले पर कर्नाटक सरकार द्वारा आयोग को कोई स्पष्टीकरण नहीं दी गई है।

राष्ट्रीय पिछड़ा वर्ग आयोग के अध्यक्ष हंसराज अहीर ने कहा कि हमने इस मामले पर कर्नाटक सरकार से पूछा था कि आखिर किस आधार पर यह कोटा दिया जा रहा है। इस मामले पर हमें कोई स्पष्टीकरण नहीं मिला है। हंसराज गंगाराम अहीर के ओर से जारी बयान में कहा गया, कर्नाटक सरकार के नियंत्रणाधीन नौकरियों और शिक्षण संस्थानों में प्रवेश में आरक्षण हेतु कर्नाटक के सभी मुस्लिम धर्मावलंबियों को ओबीसी की राज्य लिस्ट में शामिल किया गया है। बयान में आगे लिखा है,"कर्नाटक सरकार के पिछड़ा वर्ग विभाग ने राष्ट्रीय पिछड़ा वर्ग को लिखित रूप में बताया है कि मुस्लिम और ईसाई जैसे समुदाय न तो जाति है और न धर्म है। कर्नाटक में मुस्लिम की आबादी 12.92 प्रतिशत है। राज्य में मुस्लिमों को धार्मिक अल्पसंख्यक माना जाता है।"

कर्नाटक सरकार की नीती सामाजिक न्याय के सिद्धांतों के विरुद्ध
राष्ट्रीय पिछड़ा वर्ग आयोग ने कर्नाटक की इस नीति को सामाजिक न्याय के सिद्धांतों के विरुद्ध बताया है। पिछले साल NCBC ने ग्राउंड पर जाकर आरक्षण की स्थति का पता लगाया था। आयोग का कहना है कि ऐसे में मुस्लिमों में जो जातियाँ शिक्षिक-सामाजिक रूप से पिछड़ी हैं उनकी भी हकमारी हो रही है। सभी मुस्लिमों को पिछड़े समाज में डालना इस समाज की विविधता और जटिलता को नज़रअंदाज़ करने के जैसा है। 

कर्नाटक सरकार से स्पष्टीकरण मांगा
हंसराज अहीर ने कहा कर्नाटक में कैटेगरी 1बी और बी2 में कुल 34 मुस्लिम ओबीसी जातियां आती हैं, लेकिन आरक्षण जो दिया है वो समूचे मुस्लिम जातियों को दे दिया गया है। हमने पूछा कि 4 प्रतिशत की जगह 16 प्रतिशत आरक्षण कैसे दिया तो उनका गोलमोल जवाब आया है। हंसराज अहीर ने कहा कि हमने कर्नाटक सरकार से स्पष्टीकरण मांगा है। हम कर्नाटक के चीफ सेक्रेटरी को तलब कर रहे हैं। हम किसी भी तरह मूल ओबीसी के हक को मरने नहीं देंगे। हमारे आयोग का यही काम है। जरूरत पड़ेगी तो हम कर्नाटक में ओबीसी आरक्षण के कोटा से इनको हटाएंगे। हम राष्ट्रपति से भी शिकायत कर सकते हैं। बहुत सारे कानूनी उपाय हैं।

ओबीसी आरक्षण कोटे में अनियमितता की शिकायत के बाद जांच
दरअसल, राष्ट्रीय पिछड़ा आयोग को कर्नाटक में ओबीसी आरक्षण कोटे में अनियमितता की जानकारी मिली थी। उसके बाद आयोग ने पिछले 6 महीने में इसकी जांच शुरू की। आयोग ने अपने जांच के दरमियान सरकारी नौकरी, मेडिकल, इंजीनियरिंग एडमिशन और तमाम सरकारी पदों पर सीमा से अधिक मुस्लिम आरक्षण दिए जाने की बात सामने आई। गत वर्ष राज्य के सरकारी पीजी मेडिकल के 930 सीटों में दिए गए आरक्षण की जब जांच की तो उसमें चौकाने वाले तथ्य सामने आए। आयोग ने पाया कि 930 में से 150 सीट मुस्लिम वर्ग को आरक्षित किया गया है जो करीब कुल सीट का 16 प्रतिशत है। खास बात ये है कि इनमें मुस्लिम वर्ग के उन जातियों को भी लाभ दिया गया है जो आरक्षण के दायरे में नहीं आते।
